Terms of Service

1. License to Use

RakuAI™, LLC grants you a non-exclusive, worldwide, royalty-free license to use the Raku Engine runtime for both commercial and non-commercial game development. The Free tier includes templates and limited resource allocation. The Pro tier includes all features, templates, and expanded resource limits.

2. User-Generated Content

You retain full ownership of all games, .raku files, and creative content you produce using the Raku Engine. RakuAI, LLC does not claim any ownership, copyright, or license over your creations. You may distribute, sell, or modify your games without restriction, subject to the acceptable use policy below.

3. AI-Generated Content Responsibility

Games created with the Raku Engine may include AI-generated content at runtime, including NPC dialogue, dynamic difficulty adjustments, and procedural content. You are responsible for the content your games generate, including compliance with platform content ratings (ESRB, PEGI, etc.) and storefront policies (Steam, Xbox, etc.). The ai_disclosure system in every .raku file helps you declare AI usage for platform compliance.

4. Acceptable Use

You may not use the Raku Engine to:

Create malware, spyware, or software designed to harm users
Circumvent content rating systems or storefront policies
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, data structures, or internal architecture of the Raku Engine runtime, libraries, or associated binaries
Redistribute the runtime binaries under a different name or brand
Use the engine in violation of applicable laws

5. Intellectual Property and Reverse Engineering

The Raku Engine runtime, its binary components, internal APIs, modules, internal architecture, and all associated proprietary technology are the exclusive intellectual property of RakuAI, LLC, protected by multiple granted United States patents and applicable trade secret law.

You expressly agree that you will not:

Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any RakuAI binary, library, or runtime component
Use automated tools, debuggers, memory inspectors, or packet sniffers to analyze the internal operation of the engine
Extract, publish, or redistribute internal API details, export tables, internal data structures, or module architecture details obtained through any means
Create derivative works based on proprietary engine internals or attempt to build a compatible or competing runtime
Remove, alter, or obscure any patent, copyright, trademark, or proprietary notice from RakuAI software
Share, publish, or disclose any materials provided under NDA, including SDK documentation, API references, or runtime binaries, without written authorization

The .raku file format (Standard Format JSON schema) is provided as a public specification. This does not grant any license to the engine’s internal implementation. Violation of these terms may result in immediate termination of access and pursuit of legal remedies, including injunctive relief and damages.

6. Limitation of Liability

THE RAKU ENGINE RUNTIME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. RAKUAI, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SOFTWARE. Our total liability to you shall not exceed the amount you paid for the Pro subscription in the 12 months preceding the claim.

7. Termination

Free tier access may be revoked if you violate the acceptable use policy. Pro subscriptions may be terminated for ToS violations with 30 days written notice. Upon termination, you retain all .raku files and game content you have created. The runtime will continue to function for games already distributed.

8. Governing Law

These terms are governed by the laws of the State of Washington, United States. Any disputes shall be resolved in the courts of Washington State.
